Nassau County Estate

For the person who is put in charge of your deceased loved ones estate, there are a lot of new responsibilities to deal with. The legal process that occurs after a loved one passes away, known in New York State as Probate, can be a complex and time-consuming process. There are many tasks that will require time; determining heirs, distributing assets and paying creditors, this can all be a bit more than you can handle. If the deceased individual had a Will, your Nassau County Estate Lawyer will present the Will for probate. If a Will does not exist, the Estate Lawyer will file an administration petition. When there is a Will, the Estates Executor will be responsible for handling the estate. If a Will does not exist, however, a personal representative will file a petition with a Nassau County Surrogates Court at which point the Surrogates Court will appoint an administrator to the estate. Chances are you will need a Nassau County Estate Lawyer to help through this process.

A Nassau County Estate Lawyer will file a probate or administration petition in the Surrogates Court, depending on whether or not there was a Will. The probate of an estate is handled by a court located in Nassau County, assuming this is where the deceased individual lived at the time of death. After the estate lawyer files the petition, the Surrogates Court will grant the Estates Administrator the power to distribute assets and pay debt.

Your loved ones assets can include everything from money, stocks and bonds, insurance policies, investment assets and vehicles to jewelry, artwork, clothing and personal items. The Nassau County Estate Lawyer will also inform the estates administrator that they may distribute property, land and buildings that are located in Nassau County only. The Surrogates Court does not have jurisdiction over property located outside of New York.
