For family and friends of the deceased, the overwhelming responsibility of determining heirs, distributing assets and paying creditors often becomes more than one person can handle. If the deceased individual had a Will, then the Manhattan Estate Lawyer will present the Will for probate, if no Will exists, the Estate Lawyer will present the Will for administration. When there is a Will, the Estates Executor will be responsible for dealing with the estate-related tasks. If a Will does not exist, a personal representative will file a petition with a Manhattan Surrogates Court. At this point, the Manhattan Surrogates Court will appoint an administrator to the estate, often a relative or close family friend. With all of these different steps that need to be taken, you will need a Manhattan Estate Lawyer by your side.
An Estate Lawyer for the deceased individual will file a probate petition or administration petition in a Manhattan Surrogates Court, depending on whether or not there was a Will. The probate of an estate is handled by a court located in Manhattan where the deceased individual lived. After the Manhattan Estate Lawyer files the appropriate petition, the Surrogates Court has right to give the Estates Administrator the power to distribute assets and pay creditors. Assets may include everything but “real” property, such as money, stocks and bonds, insurance policies, investment assets, vehicles, jewelry, artwork, clothing and personal items. The Manhattan Estate Lawyer will inform the Administrator of the Estate that they may distribute property, land and buildings that are located in Manhattan only. The Surrogates Court does not have jurisdiction over property located outside of New York City.
