The overwhelming tasks of determining heirs, distributing assets and paying creditors can be a bit much for one person to handle. If the deceased individual had a Will, then the Queens Estate Lawyer will present the Will for probate. If no Will exists, the Estate Lawyer will present the Will for administration. When there is a Will, the Estates Executor will be responsible for handling the estate. If a Will does not exist, however, a personal representative will file a petition with a Queens Surrogates Court at which point the Surrogates Court will appoint an administrator to the estate. The Surrogates Court does not have jurisdiction over property located outside of New York City.
